Jeanne Cobb Penner's Petition for Signature for Changing the Medical Malpractice Statute of Limitations

I regretfully inform any friends here that a friend you may know has passed away. I never make this a place to do so either, however I know Jeanne had an idea she wanted to share with others and it came from her experience and that cost her her own life.

Jeanne Cobb Penner lost a long fight for her life from MRSA, as I understand it, that ravaged her body after a foreign instrument was left behind inside of her body after surgery.

I hope your thoughts and prayers can be with her loved ones in this time of need.

Jeanne needs you now though to go sign this petition and make a difference. Can you please help to make a difference with medical malpractice laws?

It is a worthy petition she started that I wish you would each please take only three minutes to read and consider signing, as it will typically somehow effect us each or a loved one or a friend in our lifetime.

Thanks for visiting this blog entry today and please take the time to thoroughly read it in its entirety and do your best to perform your own due diligence and only then offer to support the petition as you will read at the link provided after taking the time to further educate yourself about medical malpractice. Here is how Jeanne's (Jeanne Cobb Penner) petition statement reads today. I hope to further fill you in on more details about her own original procedure as well as her YEARS of suffering due to the alleged malpractice she has suffered and the further compounding of that suffering by have ZERO legal recourse for another pure negligence that has stolen years of livlihood from her already and most recently (July 2015) left her in a coma from which she recently emerged but still permanently will suffer from this original procedure.

Jeanne Cobb Penner's Petition's Statement: 

Depending on the state, the statute of limitations for medical malpractice is two to three years.  The statute needs to be changed to extend the deadline under special circumstances.

An example of the special circumstances is when a doctor leaves a foreign object in a patient during surgery.  If there are residual complications past the two to three year mark, the patient should be allowed the extra time.  I am personally in that category.  Three years ago a doctor left a foreign object inside me during surgery.  I have since had 10 surgeries to try and keep me around, and there will be more. Setting the surgery information aside, I have also been admitted to the hospital quite a few times including being in a coma three months ago.  

Please consider this change as it would not only help patients, but it would also push medical practitioners to strictly adhere to all safety requirements.

My, John Stephen Swygert's, personal reason for signing this petition. ( I included my own thoughts as this is my blog, and you may read other signers reasoning at the actual petition site as well as leave your own reasoning when you dutifully and honorably sign this petition too as Jeanne looks towards presenting these legislative changes on Capitol Hill one day in the  not too distant future in her fight for justice.

First and foremost I firmly believe my own friend, Jeanne, has suffered because of this exact reason and she has been a victim exactly because of this type of situation and has been left with no available legal resource in which to fully gain compensation for another's grave error which has robbed her permanently of time, the pursuit of happiness, fruitfulness, and the best ability of being an even more wonderful Mother, friend, daughter, etc, ad infinitum, and justice shall never have a date that passes in which she decides to turn a blind eye to errors that steal livilihood or life itself from anyone without the ability to have the proper unencumbered legal right and channels in which to best gain recognition for the error(s) and compensation as best possible financially for the loss encountered due to the malpractice, regardless of it it is directly or indirectly experienced due to the event which went tragically wrong.

My reason, as asked specifically on the petition:

I am signing this petition because there should never be any limitation at all for another's negligence (as a singular individual and/or a corporate entity) that makes a patient (turned victim) suffer to any degree at all after a mistake has been made during a medical procedure, no matter how much time has passed since the medical procedure was performed (regardless of its specific nature or need) or when its (the medical procedure's) mistake, be the mistakes cause be blamed upon ignorance,  negligence,  or any other reasoning, shows any sign of having created undue suffering above and beyond the expected, if any, effect or affect, directly related to, in origin, the medical condition that preceded the procedure, unless otherwise deemed experimental or in any other way extraordinarily threatening to life or overall general health above and beyond what is expected in similar medical situations as experienced and known to medical professionals and with all parties involved, or their legal representative(s), recognizing and agreeing to the known risks vs. the unknown possibilities of extraordinary outcomes, and when so possible to do so in non emergency situations. In emergency situations, it would be understood that all proper policy, procedure, and protocol shall be thoroughly followed with the patient's best interest in mind for both short and long term positive prognosis. The entire idea within is full accountability of all medical professionals involved to insure the patient's highest likelihood of improvement within reasonable expectation of the condition / disease, as recognized, which, based on the highest statistical likelihood known in the medical profession, so be it prayed, that healing with no unnecessary nor undue suffering should ever exist and if it does, no matter what duration of time has passed since the date of the procedure, the patient, now victim, or surviving family or legal heir, shall have the legal right to rectify the perceived malpractice, with malpractice itself being fully recognized by definition itself, whereas not only compensation shall be made eventually to the rightful party, but also with the insight to better insure all future similar situations for others be better understood and respected to further guarantee no one else's undue suffering from said procedure in question. The bottom line is there should never be any logical reason to hold any medical professional unaccountable in the event of a tragedy directly blamed upon any medical practice or procedure ill performed. 

Joe Montana Admits on ESPN that His Teammates Cheated and He Knew

On ESPN today.... while being interviewed about gaining an edge, cheating, and the Patriots today and more recently... Joe Montana admits that his offensive linemen (and all others in the NFL too at that time) utilized silicon spray on their jerseys so that the defensive players (the opposition) could not utilize their techniques as effectively ! He stated if you are not cheating you are not trying, and when further questioned... specifically about cheating... he stated... after long thought... the admission above. Great interview, honest and candid, and guess what... the players, teams, and coaches are all always looking for that edge, be it stick em, silicon spray, or deflated footballs !

So... knowing this fact... how do you feel about cheating in the NFL now? Does this tarnish Montana's 4 Super Bowl victories ?

He admittedly would like to keep the record of 4 victories as he and Brady are tied currently with Brady likely to break that record... thoughts about it all ???

Personally, I was shocked quite honestly and despise cheating and really have to think on this one a bit... argggghhhh... even one of my heroes cheated !!!.

I was on a high school team in 1985 which placed third in the state and many members of that team cheated for a fact. I only became aware of this after it was revealed to me by others, one at a time, upon my questioning them each...and it ripped my heart out to know these assholes I admired cheated to win, when I worked so GD hard and did my finest.

That sport in my high school was never the same for me nor was my desire to work hard as this fact lingered within me as I knew it was not an even playing field anymore like I had once thought. I kept my mouth shut at the time and have never mentioned until now and nor will I say any more beyond this because it has ZERO bearing on the past or future today and would do no earthly good other then to say if you cheat you are a liar and anything earned was stolen.

I may not be perfect either myself but I will tell you this... I respect integrity and will do anything in my power to maintain and protect my own and that of all of those around me. Tell me I am wrong and explain to me how in any way you can.

To know the majority of a team (the varsity team) cheated in order to compete because a prerequisite had to be met in order to compete each and every meet... well, there is a reason I am not friends with any of those cheating assholes today. As a matter of fact, if this means you too and I am simply unaware of it... delete me and never speak to me again please because I lost all respect for you 30 years ago. As a further matter of fact, if you disagree with my statement thus far or afterwards I would also prefer you delete me from your friends list as well.

Ultimately, here is the truth. When you cheat, others know or will find out and you will never be thought of the same way again... EVER !!! You steal your own integrity and with that undermine your entire future because you will always carry with you a lie and know anything gained because of it was through theft from another who was deserving because that other maintained their honor and integrity.

My personal problem with this is that 30 years later I am still bitter because I was cheated too, my teammates that were fair and honest were cheated too, our school was cheated, other schools and athletes were cheated, and how can that not leave a bitter taste in your mouth? I grew up in a family where my Father went to a college with an honor code and I feel like I broke my own honor code by not speaking up, so I will speak up now because at the very least I should, however I wish I would have spoken up then because it was the right thing to do, however it is a scary situation when it is seemingly the world against yourself... and it felt like that then and still does... the difference today is I am perfectly comfortable with myself today and I fear no man ! .

Furthermore, in my own fault, I allowed and co-signed that cheating by not being the man I should have been myself and stepping up and proving the fact I knew and let continue to happen the rest of the year.

Perhaps this is not important today to anyone at all that was involved. It is important to me still and stings as much as it did then too. I speak today only in the hope that another reads this and understands what it truly fully means to cheat and steal from another in a society where it seems like we accept it because we do not do the right thing and speak up like I should have myself. I was just as culpable by remaining silent with this knowledge at the time and want to apologize to all that I stole from 30 years ago in my silence. I am truly sorry and my own reflection still says and has always said within me that it is NEVER acceptable.

It is the only cheating scandal I have ever had direct knowledge in and 30 years of silence will hurt anyone with a conscience... make sure you never make that same mistake and share with loved ones the multitude of reasons that cheating is never acceptable.

What would be your number one reason that cheating is the wrong answer all of the time? What reason can you think of that has not been listed thus far
that others should understand and should be shared by all coaches, teachers, and parents.

This is not meant to hurt anyone at all, however it is meant to be a catalyst as a way to slowly change a society where it seems like cheating may very well be common place, acceptable if not caught, and seemingly normal practice because it has become so ingrained within so many by the example set by so many others who decided to exercise this poor choice looking for a very unfair competitive edge. Otherwise how do you explain how it has evolved all the way into even professional sports?

I did not quit that team but I did quit competing within, and from that point forward I was defeated in regards to sports and after that year never competed again. I learned hundreds of valuable lessons through athletics without a single doubt in my mind but it only took one poor lesson exercised by a conspiracy of others to destroy trust we should all hold in the highest of regards.

Montana admits openly today that others on his team cheated by pure definition. In my book that means he cheated ! I have much less (maybe zero now as I still contemplate this) respect for perhaps my absolutely favorite player of all time or very, very close to that. Joe laughed and snickered as he made these admissions... perhaps he has been torn up inside knowing this truth which he tried his best to minimize by stating everyone did it. So...what did he personally do... what was he thinking about during that long pause ? It sure looked like he knew he cheated himself but just could not make that pure of a confession.

Should I really feel such disappointment... damn right... I though this cheater and others were role models... just like MILLIONS of others.

I want to discount Lance Armstrong's cheating because he beat cancer... but he is a piece of shit that threatened others like what was done to me when I learned of the cheating and stated I may speak to an "authority"... so finally today... I have zero pity for Lance... perhaps the most sophisticated cheater ever by the fact that he was incredibly elusive for so long that he was not even caught until years later and some may argue not even 100% until he finally made these admissions himself.

Does the NFL have / need an honor code? What do you think about an honor code in general and is it effective?

The HUGE question... Should Montana be stripped of his rings after making a statement on record that he knew very well without doubt that his own teammates cheated?

Quinn​, I do not expect you to comment here on this topic, however I do hope you and the folks at your network will address this issue and have a real and candid conversation about it and perhaps cover it in an ESPN special, as I respect you and your professionalism and I think it is a topic that needs to be deeply further examined from the perspective of the damage that is done to all involved and the lies that it perpetuates.

I hope this starts a dialouge somewhere if not here and most importantly perhaps this dialouge spreads to coaches and teams and teammates and families and friends so that cheating is shunned once again and slows so that the folks on the podiums are only those that worked very hard and within the rules of any given sport.

We also have a sewage problem in town! Are the two connected? Well the scientific medical literature seems to say no, however I cannot find 100% certain truth of that, but what  have is as close to 100% as we can scientifically expect for today. So, we have two very serious issues to address, and who knows, perhaps they are still intertwined, as poor health is effected my such a multitude of factors, most of which are unknown and things that we are exposed too that we cannot see.

I am always curious to the deeper and actual causation (etiology) behind these types of diseases (virus), such as actual molecular origin. Concerning "mumps", it is indeed a very rare disease and it make some think there must be an obvious source we can isolate and then alleviate out of the equation as we move forward and make certain we will not experience this threat again if we can indeed isolate, treat and remove the origin itself, root and all !

The etiology as expressed in literature would lead one to not believe that it could be present any where other then within the human body and its fluids. Until I know the exact molecular origin from genesis until death I cannot accept that as a fully valid answer as accurate, but merely speculation based upon the best facts we can derive today utilizing the science we have at hand. Perhaps it is true that it manifests in the body and as we are the only known host that is the only place it can reside, but if it is born within the body, I think only exposure to one or more compounds must happen in order for it to manifest in an individual. I cannot accept that it has somehow hopped along over and over for eons and just survived by manner of fortune, especially in this day and age of vaccination, and this one is able to be vaccinated against however this is a virus that the vaccination is all too often refused, and of course that just offers the ability for it to continue its "life" as a virus. (not to say it meets the definition of life or that it does not)

Transmission, course, and symptoms

Humans are the sole reservoir for the mumps virus. The transmission mode is person to person via respiratory droplets and saliva, direct contact, or fomites. (See Etiology.) The presence of maternal antibodies typically protects infants younger than 1 year from the disease. Infections can be a symptomatic in 20-30% of persons. Of those with symptomatic infection, adults tend to be more severely affected when compared to children. Lifelong immunity usually follows clinical or subclinical mumps infection, although second infections have been documented.

Mumps has an incubation period of 16-18 days; however, cases can arise 12-25 days after exposure. After this period, prodromal symptoms (such as low-grade fever, malaise, myalgias, headache, and anorexia) occur; these symptoms can last 3-5 days.

After this prodromal period (about 48 h), the clinical path of the virus depends on which organ is affected. The most common presentation is a parotitis, which occurs in 30 to 40% of all patients and in 95% of those who are symptomatic. Parotitis is caused by the direct viral infection of the ductal epithelium and presents with localized gland inflammation. Other reported sites of infection are the central nervous system (CNS), eyes, pancreas, kidneys, testes, ovaries, and joints.

So, even if it appears that mumps cannot be brewing in our stagnated sewage system, it is for certain many other pathogens may indeed be and are likelie to be in the air we are breathing in these areas ad this situation needs to be properly addressed.

For well over 10 days I have smelled a foul smell as I have drive to our local theatre. That smell is due to what I was informed was called a "dry sewer" which we will have flushed A.S.A.P. and my understanding is that this is a sewer that is damaged and will take extensive work to repair properly, which of course means coming up with greater funding in our city budget, but we also have to weight this against possible health concerns as well.

However I have to think that this is not healthy at all and I know for a fact that it has been noticed by many people as we all shared discussion about it in a thread under a comment listed in facebook just yesterday August 30, 2015. It was later in the day when I same that we were having a mumps outbreak, and the incubation timing and first time I smelled this terrible stench in the air that was always there and lingering and so bad you would have to hold your breath matches that timing.

The exact area I smell this so very strongly is here at this map, and  have smelled it since at least 2015-08-20 and in particularly on the hotter days, as we had many days near 90+ where it strongly permeated the air. The rough location is W. Harrison Street and S. Centre Street 21502 .

Open the below link and read page 11 and 12 carefully, and keep in mind that although this is speaking about a sewage treatment plant, raw standing sewage in a broken pipe can be just as lethal potentially and should not be overlooked or under addressed!

The amount and survival of microorganisms in wastewater aerosols depends upon the amount of the organism in the wastewater, aeration basin, or 11 sludge; the amount of material aerosolized; what happens to the aerosol while in the air (such as drying of moisture or impact with a surface); and the die-off of the organisms with distance in the downwind direction. Even when these circumstances are known, interpreting the health risk from the information is difficult since it is necessary to consider what is the quantity of a particular pathogen required to start an infection in people.

Bacteria and viruses are not necessarily evenly distributed throughout a liquid, but can concentrate in the in the surface microlayer. This affects how many organisms can be put into the air. During aeration, when air bubbles break at the air-water interface, microorganisms are ejected into the atmosphere. The bacterial concentration in the ejected drops from bubbles may, depending upon the drop size, be from 1 to 1000 times that of the water from which the bubbles burst. "

This is indeed a critical problem ! On a level of a huge health concern as well as concerning infrastructure and the repairs so needed and budgeting to accomplish that feat. (read it all but pay particular attention to Pg. 11)

Perhaps I am incorrect, however in the least we need to plan on addressing these problems soon as they are very poor for tourism and they certainly have to be terrible for our collective health. I will not longer drive there and will purposely go around the long way for now on to get where I need to go moving forward.

What is critical is that we help our Mayor and City Council to efficiently address these issues and seek long term solutions that insure both our fiscal and physical health!

My ideas outlined herein and some research as sited is purely speculative, however it is not something that should be at all overlooked!

Infrastructure here is old, poorly documented if at all, and a huge issue concerning our budget as well as our future potential of growth. These are not uncommon problems around the country actually, however we have to solve them and we have to do so as quickly as possible.

I hope that the threat of a serious health risk may make some federal emergency type of funds, such as grants perhaps, immediately available to us, and we certainly owe it to our citizens and tourists from afar to maintain as healthy a city as possible, most especially over such known and threatening issues as these that are clearly threatening according to Cornell, a prestigious university study as enclosed herein for all to read and understand for themselves.

FOUR CASES OF MUMPS CONFIRMED AT FORT HILL

Health Department Plans After-School Vaccination Clinic for F.H.H.S. Students, Staff

Lab testing has confirmed four cases of mumps at Fort Hill High School. In response to the outbreak, the Allegany County Health Department and the Allegany County Board of Education, in cooperation with the Maryland Department of Health and Mental Hygiene (DHMH) and the Centers for Disease Control and Prevention (CDC), are planning an after-school vaccination clinic at Fort Hill for students and staff to receive a booster dose of the MMR (Measles, Mumps, and Rubella) vaccine. The clinic will be held Tuesday, September 1st, from 3 p.m. to 7 p.m. The vaccine is being provided by the CDC free of charge to F.H.H.S. students and staff.

It is recommended that all persons without medical contraindications receive two MMR doses, ideally beginning at 12 months of age and again at 4 to 6 years of age. With two doses, the vaccine is estimated to be approximately 88% effective. In order to proactively combat the spread of the mumps cases at Fort Hill, the CDC has recommended that a third dose of vaccine be administered to increase the level of protection against the mumps virus.

The vaccine requires health screening; therefore, students will need to have a parent or guardian with them who is familiar with their health history and any existing medical conditions.

Symptoms of mumps include swollen or tender salivary glands in the cheek and jaw area, fever, headache, and swollen and tender testes in teenage and adult men. Symptoms may occur most commonly within 14 to 18 days of exposure, and individuals are contagious anywhere from two days prior to becoming symptomatic up to five days after symptoms present, so it is possible to pass the mumps to others before you have symptoms. The mumps virus spreads by way of airborne droplets or close contact with respiratory secretions, so preventive measures such as frequent handwashing, avoid the sharing of food and drink and covering coughs and sneezes are recommended. Up to half of those who do contract mumps have only very mild symptoms and may not even know they had mumps.
